Why doesnt milk in chocolate spoil?

im in year 12 and am innovating my own product for food technology. they're little protein bites made with chocolate protein powder and cream and other stuff, and on the packet i need to write it's use by date, and also if it should be refrigerated. normal chocolates dont have to be refridgerated though so im not sure how to label it because my product has cream in it.
